Unions File New Unfair Labor Practice Charges against ASARCO
On July 21, 2020, we filed new unfair labor practice charges with Region 28 of the National Labor Relations Board after ASARCO failed to reinstate workers returning from the unfair labor practice strike and kept replacement workers in the returning strikers’ jobs.
On July 5, our unions notified ASARCO that we were ending the strike, ceasing all picketing activity and making an unconditional offer to return to work, effective July 6, at 8 a.m. in Arizona and 10 a.m. in Texas.
As ASARCO has ignored its obligations under federal labor laws, on August 13, we submitted our statement of position to NLRB Region 28 seeking to compel the company to return workers to their rightful jobs, expel the replacement workers from our facilities, if necessary, and make whole those who are deprived of wages by the company's continued unlawful actions.
We have also requested information concerning the alleged “permanent replacement” workers that hold our jobs, and we have demanded to bargain over the announced temporary and indefinite shutdowns of the Hayden Concentrator, Hayden Smelter and Amarillo Refinery.
Our struggle has been long and difficult, but we must continue to stand together, push for justice and hold ASARCO accountable.
