Mexican Government Refuses to Hold Grupo Mexico Accountable under USMCA
This week, Mexico refused the U.S. complaint petition against ASARCO’s parent company, Grupo Mexico, under the rapid response labor mechanism of the United States-Mexico-Canada trade agreement (USMCA).
Since Mexico has refused the complaint petition, the U.S. Trade Representative (USTR) will next determine whether to request the establishment of a rapid response labor panel and must notify Congress by August 13 if it does not plan to request a panel.
The original petition, filed in June by the Mexican National Mineworkers’ Union (SNTMMSSRM or Los Mineros), USW, and AFL-CIO, asserts that Grupo Mexico is violating Mexican labor laws by using strikebreakers to operate the San Martín mine.
Los Mineros called the Mexican government’s response an outrageous offense to fellow workers, their families and the people of Mexico, noting that the struggle has continued for more than sixteen years and calling Grupo’s continued abuse of workers “unacceptable.”
